Just make it blue.
This definitely reads like a hostage situation, but a less confusing wording for this should be something like
"At the beginning of your upkeep, choose a creature and a noncreature permanent with the same controller. Gain control of one of those permanents of that player's choice."
As its worded right now the opposing player can give you another player's permanent that you choose.
I assume this should read ", Tap an untapped Pirate you control:..."
This also isn't black. I would highly suggest this costing a little more, like .
Flagbearer effect is pretty old, but it was pretty solidly white back in the day. If you really want something that has this type of effect, I'd suggest riffing off of Imp's Mischief and Spellskite and making it something like
"Pay X life: Change the target of target spell with converted mana cost X or less to ~."
2/1 also feels like a better fit for the card's stats. It doesn't matter much in EDH other than chump blocking tiny dudes, but the amount of utility even an ability like the above would have is a fine tradeoff.
This should also be an uncommon or rare.
Sigiled Starfish is . The only other 1/3 for 1 is Permeating Mass, and this definitely isn't a Green card.

Very very powerful. This is basically Palace Siege on a stick, so maybe something like for a 3/3 is more fair, if not 3/2. This is a combination of Xenograft and it, so actually works this time. I'd probably lean more towards if you're looking for something more unique.
